As of July 24, 2009, approximately 44,900 H-1B cap-subject petitions have been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption have been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits. what is the best bet after I-140 denied?
I mean does it make any difference far as 485/EAD if the employer does appeal or MTR?
I mean is there a possibility of keeping the 485 and EAD alive after I-140 denied if employer appeal or Motion to Reopen?

The visa bulletin says "Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation"
But doesnt that mean that no I485 authorizations will happen but filing can still be done and EAD received as de facto?
Please ask your respective lawyers to clarify this with USCICS/DOS.

I applied for Substitute Labor/140/485/EAD concurrently on July 2nd. Assuming, USCIS will accept my 485, I have a few questions:
1. If I get a RFE/NOID/denial on labor/140, will I be eligible for invoking AC21?
2. Is the EAD processed after 140 approval or is it possible I would get EAD before labor/140 approval?
Can someone explain how things work when one applies for Sub labor/140/485 concurrently?

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

New filing fees were applicable from 7/30. Do all applications(485/131/765) whose PD is current need to filed with the new fees starting from 7/30? Or till 8/17 it can be filed with the old fees?

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.

Guys, Assuming that everyone from July Filers group went through FP for AOS once at that time, do they need to go again to get the AOS approved now? My question is ppl who r being approved these days and if they r july filers, did they go for 2nd FP? Can uscis use FP of EAD in 485 ?

I was wondering if anyone on this site has ever filed an EB2-NIW I-140 petition ? And if so, what fields have you filed it in ? Do you necessarily need a masters degree or would 10+ years of experience in systems development qualify ?
I was also wondering if working in the health-care technology field, to create systems to diagnose and monitor cardiovascular systems to detect/prevent heart diseases would be something that could considered in the "national interest" ? If there is a job offer already extended to someone to work on such projects, would you still need a labor certification ?
